New maternity rules have entered

On 3 March 2022, the Danish Parliament adopted a law change on earmarked leave, which came into force today, 2 August 2022. The purpose of the new rules is to promote equality between parents, single parents, and LGBTQ+ families.

The new rules include, among other things, to:

  • An employee is covered by the new leave model if the child is born on 2 august 2022 or later. If the child was born before 2 august 2022, you are basically covered by the current rules (applicable maternity rules before 2 august 2022),
  • The weeks of leave entitled to maternity allowance after the birth will, as a rule, be divided equally between the parents who live together at the time of the birth
  • Each parent will, therefore, as a rule, be entitled to 24 weeks of leave with the right to maternity allowance after the birth
  • For employees, a further 9 weekends will be earmarked, which means that you cannot transfer the right to maternity pay during the leave to another parent or to others,
  • Several other conditions for single parents and LGBTQ+ families
